Calendar A court's list of cases for arraignment, hearing, trial or arguments. Exclusive jurisdiction The matter can only be filed in one court Moot A moot point is one that need not be decided, due to a change of circumstances. Negligence Failure to exercise the care that an ordinarily prudent person would exercise in the same circumstances. Exhibit A paper, document or other article presented and offered into evidence in court during a trial or hearing to prove the facts of a case. Case law The law made by courts interpreting cases and laws as opposed to law made by legislatures. In the American system, the primary sources of law are 1) constitutions, 2) statutes/regulations, and 3) case law. Deliberation The jury's decision-making process after hearing the evidence and closing arguments and being given the court's instructions. Disposition The order of a Juvenile Court determining what is to be done with a minor already adjudged to be within the court's jurisdiction. In criminal or civil cases, the settlement of a case.

	The mediation process may vary depending on the mediator. Generally, mediations commence with a general session with all parties, counsel and the mediator. At the general session, there will be a discussion of the case, the issues on appeal and other matters important to settlement. Then the mediator will meet separately with each party and their counsel in separate "caucuses." In these separate sessions, the mediator will seek to foster negotiations between the parties and develop agreement.
